KACY VANDUINEN, DOG BREEDER
At Risk for DM by Parentage: inherited diseases
MY ACCOUNT OF BUYING A PUPPY FROM KACY VANDUINEN
DOCUMENTED IN CHRONOLOGICAL ORDER
TRIPLE M CORGIS HAS A NEW CONTRACT
MICHIGAN LAGOTTOS HAS THE SAME CONTRACT

excerpt:

This downloadable contract was added to the Triple M Corgis website at some point over the past few months, but was only recently pointed out to me. I want to reiterate that my website contains no harassment, bickering, demeaning or ill will, and I never spoke harshly to Kacy in any capacity. My website is completely legal and has been lawyer approved.
But a side note regarding the highlighted paragraph of this new Triple M Corgi contract: I'm not sure of what legal issues come into play in the event that a breeder takes back a puppy from its home because someone spoke harshly to her or said disapproving things about Triple M Corgis, whether it was said verbally, by email, text, or messaged on social media. A breeder may put anything she likes in her contract, and anybody can agree to sign it. But my biggest concern is for the puppy. If the buyer later commits one of the said offenses, and if Kacy carried out her threat and repossessed the puppy... would this action be in the best interest of the puppy?

ALL CAPS TITLE
Something else in this contract to consider is about specific genetic diseases which are "covered' under the health guarantee. Among other genetic diseases, Degenerative Myelopathy and Congestive Heart Failure are not mentioned, but Hip and Elbow Dysplasia are. Before signing a contract, pay attention to what this guarantee would mean for your sick dog, and ask if this is in the puppy's best interest..

Kacy requires a lot of expensive proof that your dog has a disease which happens to be inherited from its parents. This kind of expense is why the owner needs the refund - to help pay for treatment for a devastating condition that a breeder claims WILL NOT HAPPEN in the first place. But this guarantee requires giving your corgi or lagotto back to her. So not only would your dog be suffering from a genetic disease, he/she will know the confusion of being abandoned by you, he will also know the fear of what will happen. What will happen to your dog? Assume your money is refunded, would Kacy herself pay additional money to the vet for medical expenses? Could Kacy resell or rehome your dog to a new family with such a condition that treatment would ultimately cost more in vet bills than it would to buy a new puppy? It's tragic, but for a breeder/business owner, it is a pretty safe bet to offer a "guarantee" like this, knowing that nobody with a heart would ever ask for it.
As I said, the known inherited diseases DM and Congestive Heart Failure aren't covered by this guarantee, but Hip and Elbow Dysplasia are, in Kacy's view, "guaranteed".

The very best guarantee would be to DNA test all the breeder's adult dogs, and mate only those combinations where it's NOT possible to pass on inherited diseases to your puppy.
